NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 53A-20-103 requires the Utah State Board of Education (Board) to prepare an annual school plant capital outlay report of all local education agencies, which includes information on the number and size of building projects completed and under construction; and Section 53A-1-401 allows the Board to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R277-454 continues to be necessary because it specifies the standards local boards of education shall follow in using construction management for school construction projects. Therefore, this rule should be continued.
