NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Title 73, Chapter 10, establishes the Board of Water Resources and details its authority and procedure for providing loans for constructing water projects, bringing state-owned dams up to current standards, and funding large state water projects.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The Board of Water Resources receives many applications each year for funding assistance to build much needed water projects and upgrade existing dams to current standards throughout the state, and has been directed by the state legislature to establish a fund to help pay for future large water projects in the state (Lake Powell Pipeline and Bear River Development). Therefore, this rule should be continued.
