RULE ANALYSIS
Purpose of the rule or reason for the change:
The change removes the reference to Section 31A-22-613.5 which was repealed in H.B. 336, Health Reform Amendments, passed during the 2017 General Session.
Summary of the rule or change:
The only change in the rule is to remove reference to Section 31A-22-613.5, which was repealed in H.B. 336 (2017). However, the Department still has rulemaking authority for the provisions of this rule which were previously cited in the rule.

Comments by the department head on the fiscal impact the rule may have on businesses:
After conducting a thorough analysis, it was determined that this proposed rule will not result in a fiscal impact to businesses. V. DEPARTMENT HEAD'S COMMENTS ON THE ANALYSIS: This change was necessary because of legislative action taken during the 2017 General Session. The effects of the change only apply to the Department and will have no fiscal impact on it or any other persons in the state.

This rule is promulgated pursuant to
Subsection[s] 31A-2-216[and 31A-22-613.5] wherein the commissioner [is directed to educate consumers and to adopt a rule for
purposes of reporting transparency information]may adopt rules to educate health care consumers by producing or
collecting and disseminating education materials to
consumers.
