NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53A-1-401 allows the Utah State Board of Education (Board) to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law; Section 53A-14-101 directs the Board to appoint an Instructional Materials Commission and directs the Commission to evaluate instructional materials for recommendation by the Board; and Section 53A-14-107 directs the Board to make rules that establish the qualifications of the independent parties who may evaluate and map the alignment of the primary instructional materials and requirements for the detailed summary of the evaluation.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

Mountain State Schoolbook Depository submitted a comment with recommended amendments to the rule's language on depository requirements.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R277-469 continues to be necessary because it provides definitions, operating procedures and criteria for recommending instructional materials for use in Utah public schools; provides for mapping and alignment of primary instructional materials to the Core consistent with Utah law; and provides rules for purchase and distribution of instructional materials within the state. Therefore, this rule should be continued.
