NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Pursuant to Subsection 63M-4-503(1)(a), the Office of Energy Development may make rules establishing standards an alternative energy entity shall meet to qualify for a tax credit.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Office of Energy Development has not received any written comments supporting or opposing this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should be continued because in the absence of it the qualifications for an alternative energy entity to receive tax credits would not have the legal and administrative framework that it requires in order to be carried out responsibly.
