NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized under Subsection 63A-5-103(1)(e), which directs the Utah State Building Board to make rules necessary for the discharge of the duties of the Division of Facilities Construction and Management (DFCM). All actions under this rule that refer to DFCM shall be undertaken by the Director of DFCM or the Director's duly authorized designee. This rule is also authorized and intended to implement the requirements of Section 63A-5-401, as well as Subsection 63A-5-103(1)(e)(iii).

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is needed because it provides authorization for DFCM to buy, sell, or exchange real property to ensure that the transaction is in the best interest of the state and that the value of the real property is congruent with the proposed price and other terms of the purchase, sale, or exchange. Therefore, this rule should be continued.
