NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is adopted under the authority of Section 62A-15-105, with the purpose of providing guidance on the visitation of patients at the Utah State Hospital.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received by the Division of Substance Abuse and Mental Health over the past five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should be continued to ensure that patient care at the Utah State Hospital is not impeded when appropriate measures are to be taken to limit outside influences that could disrupt the well being and safety of an individual or unit. It will ensure that family members are provided with reasonable access to patients undergoing care and treatment at the hospital, and ensure proper measures are taken to limit patient access to items that could be brought into the campus that might cause disruption or harm.
