NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 54-4-1 authorizes the Public Service Commission (PSC) to supervise and regulate every public utility in this state. Section 54-4-14 authorizes the PSC to require utilities to perform specific acts intended to promote and safeguard the health and safety of employees, customers, and the public. Section 54-4-16 requires the PSC to investigate accidents associated with a utility property.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments were received in the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It is necessary that this rule be continued because accidents of public utilities may have an impact on rates. Also, the PSC has a duty to investigate accidents involving utility property that results in loss of life or injury to persons, or property.
