NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by the Utah Constitution Article X, Section 3, which vests general control and supervision of public education in the State Board of Education (Board), Subsection 53A-1-403(2)(b) requires the Board to adopt rules for the distribution of funds for the education of youth in custody, and Subsection 53A-1-401(3) allows the Board to adopt rules in accordance with its responsibilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R277-709 continues to be necessary because it specifies operation standards, procedures, and distribution of funds for youth in custody programs. Therefore, this rule should be continued.
