NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Rule R277-719 is authorized by the Utah Constitution Article X, Section 3, which vests general control and supervision of public education in the State Board of Education (Board), Subsection 53A-1-401(3) allows the Board to adopt rules in accordance with its responsibilities, Subsection 53A-19-201(1) allows the Board to set standards relating to the use of school lunch revenues, and Subsection 53A-1-402(1)(e) requires the Board to establish rules concerning school productivity and cost effectiveness measures and federal programs.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R277-719 continues to be necessary because it outlines requirements for Local Education Agency (LEA) policies regarding foods sold outside of the reimbursable meal service. Therefore, this rule should be continued.
