NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Sections 63G-3-201, 64-13-10, and 64-13-39.5 require governmental entities to follow a consistent process of notification to facilities, and the public, when a chronically or terminally ill offender is placed in a Utah Department of Corrections (UDC) assisted care facility.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The purpose of this rule is to define the UDC policy for a consistent format and procedure of notification to facilities, and the public, when a chronically or terminally ill offender is placed in an assisted living or nursing care facility by the UDC, and provide a training program for facility residents and employees to help ensure safety. Therefore, this rule should be continued.
