NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Sections 26-2-16 and 26-2-17 which requires a rule for an authorization record pertaining to the receipt, removal, delivery, and final disposition of a dead body or dead fetus. It also allows for a rule about issuance of permits for disinterment and reinterment prior to disinterment of a dead body or dead fetus.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Office of Vital Records and Statistics has not received any written comments since the last five-year review of this rule from interested persons supporting or opposing the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should be continued because it sets forth the requirements and authorization for transportation, preservation, and final disposition of a dead body or dead fetus. It specifies the requirements for issuance of permits for disinterment and reinterment.
