NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 41-6a-310 and Subsection 53-1-108(1)(c) authorize the commissioner of the Department of Public Safety (Department) to make rules, consistent with the chapter, governing the use, in emergencies, of signal lights on privately-owned vehicles, and to authorize such vehicles to be designated for part-time emergency use.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received by the Department regarding this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Continuation of this rule is necessary in order to clarify the requirements for a privately-owned vehicle to be designated as emergency vehicles as authorized under Section 41-6a-310.
