NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is authorized by Utah Constitution Article X, Section 3, which vests general control and authority over public education in the Utah State Board of Education (Board), by Subsection 53A-17a-166(1)(b) which appropriates funds to be used for Gang Prevention and Intervention Programs in the schools, and Subsection 53A-1-401(3) which allows the Board to adopt rules in accordance with its responsibilities.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments were received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary because it establishes standards and procedures for distributing funding for gang prevention and intervention programs in public schools. Therefore, this rule should be continued.
