NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is authorized by Utah Constitution X, Section 3, which vests general control and supervision in the Utah State Board of Education (Board), and by Subsection 53A-1-401(3) which allows the Board to adopt rules in accordance with its responsibilities.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments were received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary because it directs LEAs under the general control and supervision of the Board to adopt and enforce a head injury policy for students participating in sporting events as defined in the law, including notification to parents of the policy and receipt from parents of signed statements that parents understand and will support the LEA in the enforcement of the policy. Therefore, this rule should be continued.
