NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is authorized by Utah Constitution Article X, Section 3, which vests general control and supervision of public education in the Utah State Board of Education (Board), Section 53A-1-402.5 which directs the Board to make rules that establish basic ethical conduct standards for employees who provide public education-related services or activities outside of their regular employment, and Subsection 53A-1-401(3) which permits the Board to adopt rules in accordance with its responsibilities.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments were received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary because it provides direction and parameters for employees who provide or participate in public education-related services or activities outside of their regular public education employment. Therefore, this rule should be continued.
