NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 4-17-103 mandates that the Commissioner of Agriculture and Food establish a list of noxious weeds and take steps to prevent the spread of these weeds in the state of Utah. This rule establishes the list and categories of noxious weed in the state.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The Department of Agriculture and Food (Department) received comments asking to include more plants on the list of noxious weeds.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is necessary to prevent the spread and establishment of noxious weeds in the state which could cause economic and environmental damage. The Department continues to update this list with new plants as new species continue to enter the state via interstate commerce. Therefore, this rule should be continued.
