NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

This rule implements Section 41-22-10.1 which requires off-highway vehicle use designations.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Division of Forestry, Fire and State Lands (Division) has not received an written comments regarding this rule during the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule implements Section 41-22-10.1 which requires off-highway vehicle (OHV) use designation on lands administered by the Division. This rule sets forth the OHV use categories, method of designating OHV use, and the Director's authority with regard to OHV use. Therefore, this rule should be continued.
