NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 72-7-108(3)(c) states that the Department of Transportation (Department) shall establish a schedule of rates of compensation for longitudinal access granted under that section, and shall do so beginning 10/01/1999, and in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act. This rule satisfies that requirement.

The Department has not received any written comments during and since the last five-year review of this rule from interested persons supporting or opposing this rule.

This rule must be continued because the Department still uses it to regulate the subject matter and the statute requiring this rule is still in force.
