NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Utah Constitution Article X, Section 3, which vests general control and supervision of public education in the Board of Education (Board), Subsection 53A-1-401(3), which permits the Board to adopt rules in accordance with its responsibilities, and Subsection 53A-1-402(1)(a) which directs the Board to establish rules and minimum standards for the qualification and licensing of educators and ancillary personnel who provide direct student services.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments were received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R277-527 is due for its five-year review and continuation by no later than 10/08/2018. This rule is necessary. Therefore, this rule should be continued. Rule R277-527 is also amended to provide technical, conforming, and stylistic changes in accordance with the Rule writing Manual for Utah and Board policies. (EDITOR'S NOTE: The proposed amendment to Rule R277-527 is under Filing No. 43201 in this issue, October 1, 2018, of the Bulletin.)
