NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Sections 63G-3-201, 64-13-10, and 64-13-25. The purpose of this rule is to provide policies and procedures for the screening, testing, interviewing, and selecting of applicants for Department of Corrections employment.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There were no comments received. However, an amendment has been filed to make some identified corrections. (EDITOR'S NOTE: A proposed amendment to Rule R251-105 is under Filing No. 43218 in this issue, October 15, 2018, of the Bulletin.)

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is simply needed to continue to guide hiring practices.
