NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53G-6-405 directs the Utah State Board of Education (Board) to provide a formula, by rule, for resident students to attend school districts under 53G-6-401. The purpose of this rule is: a) to establish necessary definitions; b) to establish a formula for the residual per pupil expenditure for school districts to reimburse each other for full and part-time nonresident students; c) to summarize school, school district, and state responsibilities under Section 53G-6-401; and d) to provide a standard statewide open enrollment form required under Subsection 53G-6-402(4)(b)(ii).

This rule continues to be necessary because it directs the Board to provide a formula, by rule, for resident students to attend school districts under Section 53G-6-401. Therefore, this rule should be continued.
