NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Title 67, Chapter 19e, enacts the administrative law judge conduct oversight provisions. In Section 67-19e-104, the Department of Human Resource Management (DHRM) is granted specific rulemaking authority to establish minimum performance standards, procedures and standards for complaints, promulgating a code of conduct, and a procedural fairness program for administrative law judges employed by state agencies.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

DHRM has not received any comments on this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule must continue in order to enact and continue operation of the requirements of Title 67, Chapter 19e.
