NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is authorized by Subsection 53E-3-401(4), which allows the Utah State Board of Education (Board) to make rules to execute the Board's duties and responsibilities under the Utah Constitution and state law.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R277-400 continues to be necessary because it establishes general criteria for emergency preparedness and emergency response plans; and directs local education agencies (LEAs) to develop prevention, intervention, and response measures; and prepare staff and students to respond promptly and appropriately to school emergencies. Therefore, this rule should be continued.
