NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Utah Constitution, Article X, Section 3, which vests general control and supervision of public education in the State Board of Education (Board), by Subsection 53E-3-501(3), which authorizes the Board to administer and distribute funds made available through programs of the federal government, and by Subsection 53E-3-401(4), which allows the Board to adopt rules in accordance with its responsibilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R277-724 continues to be necessary because it establishes eligibility criteria for new sponsors to recruit participants for child care centers and day care homes in unserved areas. Therefore, this rule should be continued.
