Subsection 53-3-104(1)(a) authorizes the Division of Driver License (Division) to create rules for examining driver license applicants necessary for the safety and welfare of the public. Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is authorized under Subsection 53-3-104(1)(a) and is necessary in order to define driving restrictions and codes authorized for use by the Division under Section 53-3-208 in order to ensure that an applicant is safe to operate a motor vehicle. Therefore, this rule should be continued.
