NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Title 26, Chapter 21, is the health code that mandates the licensing of health care facilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments from any party regarding this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to be required by Title 26, Chapter 21, of the Health Facility Licensure and Inspection Act. There are 46 freestanding ambulatory surgical centers in Utah. The Department of Health agrees with the need to continue this rule.
