NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Sections 63N-6-203, 63N-6-401, 63N-6-406, and 63N-6-408 require the Office of Economic Development to make rules to: establish the manner by which it allocates, issues, calculates, certifies, and provides for the application for, or transfer and redemption of, contingent tax credits; establish criteria and procedures for assessing the likelihood of future certificate redemptions by designated investors; and set a target rate of return or range of returns for the investment portfolio of the Utah Fund of Funds.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The Governor's Office of Economic Development (GOED) has not received comments on this rule during the last five years.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is required under Sections 63N-6-203, 63N-6-401, 63N-6-406, and 63N-6-408. Therefore, this rule should be continued.
