NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is promulgated under Subsection 4-2-102(1)(i) enabling the Utah Department of Agriculture and Food (UDAF) to conduct investigations, subpoena witnesses and records, conduct hearings, issue orders, and make recommendations concerning all matters related to agriculture, specifically, related to dairy issues and production of grade A, pasteurized milk. UDAF is mandated by the Public Health Service/Food and Drug Administration (PHS/FDA) to adhere specifically to the regulations and guidelines presented in the PHS/FDA 2013 Pasteurized Milk Ordinance (PMO). In order to stay within the parameters of the 2013 PMO, UDAF must have authority to practice the provisions listed in Subsection 4-2-103(1)(i).

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received since the last five-year review of this rule. There have been no comments in opposition to this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

UDAF must be able to continue monitoring, and when necessary, directing the production and distribution of Grade A pasteurized milk in the state of Utah, as long as the dairy industry maintains a presence in the state. Therefore, this rule should be continued.
