NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Subsection 53-2a-1102(7), which requires the Division of Emergency Management (Division), with the approval of the Search and Rescue Advisory Board, to make rules for the administration of the Utah Search and Rescue Financial Assistance Program, and the Utah Search and Rescue Assistance Card Program.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Division has not received any written comments regarding this rule since the last five-year review of the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is required under Subsection 53-2a-1102(7), and is needed in order to establish costs that qualify as reimbursable expenses, define procedures for counties to submit expenses and be reimbursed, define participants in the assistance card program, define procedures for issuance of the assistance card, define excluded expenses not eligible for reimbursement, establish the renewal cycle of the assistance card, establish the frequency for review of the fee schedule, and provide a formula to govern the distribution of available money among the counties for uncompensated search and rescue expenses. Therefore, this rule should be continued.
