NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is authorized by Utah Constitution, Article X, Section 3, which vests general control and supervision of the public school system under the Utah State Board of Education (Board), by Subsection 53E-3-401(4), which allows the Board to adopt rules in accordance with its responsibilities, and by Section 53G-10-304, which directs the Board to provide a rule for a program of instruction within the public schools relating to the flag of the United States.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There were no written comments received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The purpose of this rule is to provide direction for patriotic, civic, and character education programs in local education agencies. Therefore, this rule should be continued.
