NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Title 40, Chapter 2, Coal Mine Safety, gives the Division of Boiler, Elevator and Coal Mine Safety (Division) rulemaking authority. In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the Labor Commission has made this rule.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments have been received since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule was established for the purpose of improving coal mine safety, preventing coal mine accidents, and improving coal mine accident response consistent with the the Coal Mine Safety Act. To date, the Division has not received any negative responses to this rule. Therefore, this rule should be continued.
