NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is authorized by Subsection 53-9-103(6), which allows for the Commissioner of the Department of Public Safety to make rules governing the administration of the provisions of Title 53, Chapter 9, Private Investigator Regulation Act.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comments were received during and since the last five-year review of this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is authorized under Subsection 53-9-103(6), and is needed in order to outline the process for application, issuance, and renewal of a private investigator license; suspension or revocation of a license; and the classification of records compiled in connection with an investigation or a complaint. Therefore, this rule should be continued.
