Purpose of the rule or reason for the change:

Rule R307-214, National Emission Standards for Hazardous Air Pollutants (NESHAPs), must be updated periodically to reflect changes to the NESHAPs as published in Title 40 of the Code of Federal Regulations (40 CFR) Parts 61 and 63. This action incorporates changes that where made to 40 CFR Parts 61 and 63 incorporated by reference in Rule R307-214, including the five new NESHAPs contained in 40 CFR Part 63 for Source Categories, promulgated from 07/01/2009 through 07/01/2010.

Summary of the rule or change:

The version of the CFR for environmental regulations has been updated to 07/01/2010; therefore it is necessary to update Rule R307-214. The provisions of Title 40 of the Code of Federal Regulations (40 CFR) Part 61, National Emission Standards for Hazardous Air Pollutants, effective as of July 1, 2010[09], are incorporated into these rules by reference.
