NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Rule R131-4 is enacted under the authority of Section 63C-9-301 which directs the Capitol Preservation Board to make rules to govern, administer and regulate the executive director and staff. This rule requires the Capitol Preservation Board to adopt rules that are substantially similar to the requirements of the Utah Procurement Code, Title 63G, Chapter 6. Rule R131-4 ensures the fair and equitable treatment of all persons who deal with the Capitol Preservation Board, provides increased economy in Capitol Board Preservation Board procurement activities, and fosters effective broad-based competition within the free enterprise system.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Capitol Preservation Board and executive director have not received written comments, either in support or opposition to Rule R131-4.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R131-4 rule requires the Capitol Preservation Board to adopt rules that are substantially similar to the requirements of the Utah Procurement Code, Title 63G-6. Rule R131-4 ensures the fair and equitable treatment of all persons who deal with the Capitol Preservation Board, provides increased economy in Capitol Board Preservation Board procurement activities and fosters effective broad-based competition within the free enterprise system. Therefore, this rule should be continued.
