NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 4-9-2 allows the Department to adopt uniform packaging and labeling regulation, modify the Uniform Packaging and Labeling Regulation, adopted by the national conference on Weights and Measures in Handbook 130, Uniform Laws and Regulations in the Areas of Legal Metrology and Engine Fuel Quality, National Institute of Standards and Technology, which otherwise shall apply to packaging and labeling in the state.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments in support or opposing have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

As a regulatory agency, there is still have a need for a regulation to provide and have adequate information on packages. This regulation requires the identity and quantity of contents so that purchasers can make price and quantity comparisons. This permits fair competition among businesses, and provides uniformity and protection to consumers in commercial weights and measures practices. Therefore, this rule should be continued.
