NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53-3-903(1) directs the Division to make rules for the Motorcycle Rider Education Act. Subsections 53-3-903(5) and (6) establish that the course curriculum shall meet or exceed the national standard prescribed by the Motorcycle Safety Foundation and approve instructors for the program that have met the teaching requirements of the Motorcycle Safety Foundation or other nationally recognized organizations. Course completion certificates shall be issued to persons who successfully complete the requirements of the course.

No written public comment has been received in reference to this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is necessary to continue the standards and guidelines which assist motorcycle training schools and the division in the operating of the motorcycle rider education program. Therefore, this rule should be continued.
