NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Under Section 23-23-3, the Wildlife Board is authorized to provide rules applicable to cooperative wildlife management units organized for the hunting of small game and waterfowl.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Division of Wildlife Resources and the Wildlife Board have not received written comments supporting or opposing this rule. However, during Regional Advisory Council and Wildlife Board public meetings, the Division has received verbal comment, both in support and opposition to Rule R657-21. Any comments received in opposition to the rule are resolved using existing policies and procedures or the issue is placed on the Regional Advisory Council's and Wildlife Board's agenda for review and discussion during the process for taking public input. The public is welcome to view the Regional Advisory Council minutes, Wildlife Board minutes and administrative record for this rule at the Division of Wildlife Resources.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R657-21 provides the procedures, standards, and requirements for the establishment of a cooperative wildlife management unit. The provisions adopted in this rule are effective in providing the standards and requirements for establishing cooperative wildlife management units and providing adequate protection to landowners who open their lands for hunting and provide additional hunting opportunities. Continuation of this rule is necessary for continued success of this program.
