NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The Judicial Selection Act (Title 78A, Chapter 10) establishes procedures for selecting state court judges. Among those procedures is the establishment of judicial nominating commissions and the use of those commissions in the judicial selection process. The Judicial Selection Act requires CCJJ to establish rules regarding the governance of judicial nominating commissions.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The Judicial Selection Act and the Utah Constitution continue to require the use of judicial nominating commissions. The current rule provides clarity on the governance of the commissions, establish expectations for commission members, and provide information to the public regarding the selection of judges. Therefore, this rule should be continued.
