NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized under Sections 63G-3-201 and 64-13-10, and Subsection 64-13-36(3)(a) of the Utah Code. The purpose of this rule is to designate the persons who will be permitted access to information in Department of Corrections inmate medical files.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments were received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It is important for those entities having legitimate penological interests to have access to inmate medical records. Results of medical testing shall be provided to the Board of Pardons and Parole, designated department adult probation and parole agents, and the Department of Health. Therefore, this rule should be continued.
