NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 4-9-2 authorizes the department to promulgate rules regarding the standards for weights and measures. The statute also requires registration of servicepersons who use devices for commercial weighing and measuring.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received by the department since the last five-year review of the rule supporting or opposing this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule requires individuals involved in this service to be able to demonstrate competence to utilize the equipment that has been certified. This allows companies to know that these individuals are licensed to perform this critical work. Therefore, this rule should be continued.
