NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 4-9-2 authorizes the department to promulgate rules regarding the standards for weights and measures.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No comments have been received by the department since the last five-year review in supporting or opposing the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The purpose of this rule is to enable the State Metrology Laboratory to maintain its certification from the National Institute of Standards and Technology. This certification is required for weights and measures in Utah to be recognized as meeting national and international standards for commerce. Therefore, this rule should be continued.
