NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 53A-16-101.5(4) allows the Utah State Board of Education (Board) to adopt rules regarding the time and manner in which a student count shall be made for allocation of funds and Subsection 53A-1-401(3) allows the Board to adopt rules in accordance with its responsibilities.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
No written comment has been received.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary because it provides standards and procedures for public schools to receive financial resources to implement a component of a school's improvement plan or charter document in order to enhance and improve student academic achievement. Therefore, this rule should be continued.
