NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 35A-3-302(5)(b) gives the Department the authority to make rules to establish eligibility for the Family Employment Program. Subsection 35A-3-304(4) gives us the authority to define full-time work. Section 35A-1-104 authorizes the Department of Workforce Services to adopt rules. Subsection 35A-1-104(4) authorizes the Department to establish eligibility standards for its programs.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received in the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is necessary to establish eligibility standards for the Family Employment Program including income limits, how to count household size, citizenship requirements, participation requirements, specified relative assistance requirements, time limits, drug testing, and other program eligibility standards. Without this rule, the Department could not administer the program or determine eligibility or pay level. Therefore, this rule should be continued.
