NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-13-106(5) directs the Utah State Board of Education (board) to make rules specific to limited areas of firearm safety instruction in the public schools; and Subsection 53A-1-401(3) allows the board to adopt rules in accordance with its responsibilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to be necessary because it provides directions to local education agencies (LEAs) to designate public school areas and review materials that may be used for firearm safety training. Therefore, this rule should be continued.
