NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Section 35A-4-404 provides that the Department of Workforce Services can adjust the base period in cases where a claimant was on workers' compensation.

There have been no written comments during the last five years.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The rule is necessary to provide information to claimants on how their claim will be handled in the event of a workers' compensation claim. Therefore, this rule should be continued.
