NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Authority is granted by Subsection 63G-3-201(2). These provisions authorize the department to charge a fee that will provide for maintenance, operation, and improvement of Preservation Pro.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
Users and administrators were supportive of the rule that authorizes fees for the program.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The fee authorized by the rule provides maintenance, support, and improvement of an important tool. The fees are established by the Legislature and reflect the costs of doing business. Therefore, this rule should be continued.
