NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 35A-1-104 requires that the Department of Workforce Services will contract with other agencies, people, or entities in the performance of its duties. This rule spells out a provider's responsibilities and establishes a code of conduct that all providers are required to follow. This code of conduct requires providers to obey Utah and federal law.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received in the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is necessary to ensure that all providers paid by the Department comply with state law as outlined in this rule. Therefore, this rule should be continued.
