NOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Rule R940-6 is mandated by Section 72-1-304, which requires the Transportation Commission to develop a written prioritization process for the prioritization of new transportation capacity projects and promulgate the process into an administrative rule.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The Department has not received any comments about this rule since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Section 72-1-304 is still a valid statute and it has not been amended to eliminate the requirement for the rule. Therefore, this rule should be continued.
