Administrative Rules Reauthorization Bill Approved as Committee Bill

The Administrative Rules Review Committee met on 01/18/2011.  As one of the agenda items, committee members voted to approve the annual Administrative Rules Reauthorization bill.  This year, the language of the bill reauthorizes all administrative rules.

The Administrative Rules Reauthorization bill is required by Section 63G-3-502.  Statute provides that “every agency rule that is in effect on February 28 of any calendar year expires on May 1 of that year unless it has been reauthorized by the Legislature.”  It then requires the Administrative Rules Review Committee to prepare omnibus legislation to reauthorize rules.

During the discussion on the motion to approve the bill as a committee bill, Sen. Mark Madsen indicated that he is aware of several rules where a particular agency may have exceeded its statutory authority.  Staff indicated the Sen. Madsen could amend the bill once it is introduced, either in standing committee or on the floor, to except from reauthorization specific rules.

This year, Rep. Curtis Oda will sponsor the Administrative Rules Reauthorization bill.
